Summary

As the Assistant Executive Director for Compliance and Field Operations for an independent health and safety regulatory agency, you will be leading 145 employees in Bethesda, MD and across the Nation who are dedicated to saving lives and keeping families safe from hazardous consumer products. Duties

This highly visible and consequential position directs the development, planning, and execution of Consumer Product Safety Commission's (CPSC's) compliance and enforcement activities while improving the efficiency, quality, and timeliness of delivering safety results for consumers. The incumbent manages, and as necessary, adjusts and establishes systems to ensure consumer product hazard issues are prevented and /or resolved on a timely basis. Critical to success in the role is the ability to lead the compliance team in the identification and management of consumer product hazards, while managing compliance and enforcement costs and work flow, reducing "bottlenecks," improving resource utilization, improving the timely completion of internal projects, and improving the efficiency and effectiveness of the compliance and enforcement effort. As the Assistant Executive Director (AED) for the Office of Compliance and Field Operations, the incumbent is responsible for organizing, staffing, coordinating, and controlling the day-to-day, substantive compliance as well as administrative litigation relating to safety enforcement. The AED establishes and evaluates operational policies, makes decisions on programs and specific matters, establishes priorities, and allocates resources, all in furtherance of consumer product safety efforts. The AED reports directly to the Deputy Executive Director for Safety Operations. Specific activities associated with this position include:

  1. Managing and coordinating the work of the subordinate Deputy AED and Division Directors;
  2. Conducting the Commission’s enforcement, compliance and field operations activities;
  3. Conducting case development and administrative litigation to obtain effective and meaningful corrective actions in coordination with the Office of the General Counsel;
  4. Providing advice and guidance to regulated industries on how to comply with all CPSC-administered laws and regulations;
  5. Promoting industry compliance with existing safety requirements;
  6. Reviewing proposed standards and rules with regard to their enforceability;
  7. Identifying and acting promptly on safety hazards in consumer products already in distribution;
  8. Enforcing the requirement that firms identify and report products that could present possible substantial hazards;
  9. Conducting civil penalty investigations on companies that have not complied with CPSC-administered acts; and
  10. Working closely with the Office of Import Surveillance and the Office of Risk Reduction to advance consumer product safety programs and enforcement.

This is a Public Trust Position. Employment in this position requires a background investigation. One year probationary period required for initial SES appointment.

Please give examples and explain how often you used your skills, the complexity of the knowledge possessed, the level of people you interacted with, the sensitivity of the issues you handled managing a large public or private sector organization that administers complex, rules-based benefits or services, etc. It is recommended that you draft your MTQs in a word document and then insert into our system (limit of 6,400 characters for each narrative).

  1. Knowledge of investigation and enforcement principles sufficient to lead, direct, and supervise a large, multi-disciplinary organization charged with: 1) investigations of consumer product hazards, 2) handling of violations of mandatory standards, 3) development of corrective action programs, and 4) civil penalty investigations.
  2. Ability to conduct successful negotiations to obtain corrective actions with major manufacturers, importers, manufacturers, retailers, distributers, and their counsel.
  3. Ability to frame and supervise administrative adjudications to enforce consumer product safety laws and regulations.
  4. Ability to apply the laws administered by the CPSC to the facts of individual cases, the ability to communicate and teach this skill to subordinates, the ability to communicate with and represent senior CPSC leadership with high level government and non-government officials, stakeholders and firms about their responsibilities under the statutes administered by the Commission.

Education

Basic Requirement: All applicants must possess a J.D. or LL.B. degree and be an active member of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. In addition to basic requirement and qualifying specialized experience, applicants must have a minimum of five years (seven years preferred) of experience as a practicing attorney (post bar admission). All applicants are required to provide proof of current, active bar membership/good standing.

How You Will Be Evaluated

You will be evaluated for this job based on how well you meet the qualifications above.

Applicants will be rated and ranked by the CPSC Executive Resources Board (ERB) using only the information submitted for consideration. Applicants are to separately address the ECQs (unless exempted) and the Technical Qualifications question listed in the announcement by documenting demonstrated experience, training, and/or education. Applicants who do not separately address the required qualifications will be ineligible for consideration. The ERB will rate and rank each applicant based on the qualification requirements and refer the top candidates to the selecting official. The selecting official will consider the best qualified applicants referred based on the information provided, and possibly a personal interview. The ERB will approve the final selection and forward to the Chairman of CPSC. In competitive cases, the Office of Personnel Management (OPM) will certify qualifications through the OPM Qualifications Review Board.
