Duties
As a ATTORNEY-ADVISER (GENERAL), GS-0905-13, you will perform the following duties:
1. Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; and a full spectrum of expert legal advice. Acts as a legal adviser and attorney for the state/territory National Guard, responsible for assisting in the formulation of state/territory legal policy pertaining to prevention of sexual assault, sexual harassment, and domestic abuse, while serving as the special legal advisor to the Adjutant General, the Office of Staff Judge Advocate (OSJA), Commands SHARP and SEEM programs. Primary coordinator and advisor in the OSJA pertaining to military justice/adverse actions that are initiated against alleged offenders. Serves as the primary point of contact for outside entities and stakeholders, including Special Victims' Counsel, Defense Services, the SARC and the SEEM Manager preventing future harm to victims by ensuring the proper procedures are implemented and followed and that justice and adverse actions are administered properly . Assignments include some of the most diverse, complex, difficult, and novel legal issues found in the emerging area of victims' right law and is responsible for the formulation of state/territory legal policy and its execution in the area of sexual assault accountability, prevention, and response; sexual harassment; domestic abuse and lines of duty and medical discharges for Army and Air personnel . Responsible for advising and providing legal sufficiency reviews of Adjutant General and other senior leaders messages of sexual assault and sexual harassment prevention methods in formal and informal settings , and the review of any implementation of DoD policy or guidance related to competencies leaders must have related to overseeing prevention.
2. Responsible to advise on the legal, factual, and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted, sensitive, and emotionally charged issues relating to sexual crimes, harassment, domestic violence/abuse, and to the prevention and response of sexual crimes, harassment, and domestic violence/abuse. Serves as legal counsel to Adjutant General and Commanders on legislation, regulation, or guidance as to creating protective environments and promoting healthy social norms specific to military communities, which can include advising on any collaborations with local, state, and federal partners such as county health departments, State health departments, schools, the CDC, Department of Education, other government agencies, academia, and/or other industry that can ensure that the military can evaluate and assess the impact of their community-level prevention strategies both in the short and long-term . Responsible for advising on any policy or guidance regarding the removal of restrictive policies on sensitive data collection in order to advance primary prevention of sexual harassment and sexual assault in the military . Conducts outreach on behalf of the organization to legal entities and organizations, including State Bar, and statewide civilian organizations who support victims, and conducts training to the organization and leaders regarding legalities/requirements in addressing prevention and response of special crimes, domestic violence, and sexual assault. Serves as legal counsel and advises on any legislation, policy, or guidance providing for an authorization and funding for NGB to conduct recurring National Guard unit inspections and staff assistance visits for prevention and oversight of sex crimes, harassment, and domestic violence/abuse.
3. Serves as the state/territory National Guard litigation point of contact. Represents the state/territory National Guard in all legal matters in state/territory of original or appellate jurisdictions, to include matters pertaining to sexual crimes, sexual harassment, and domestic violence/abuse. Acts as agency counsel for the state/territory National Guard with the National Guard Bureau Office of Litigation and Employment Law Division, Department of Army and Department of Air Force Litigation Divisions, and the Department of Justice, for Federal courts of original or appellate jurisdictions.
4. Performs other duties as required.

Conditions of Employment
Ohio Army National Guard Membership is required.
Males born after 31 December 1959 must be registered for Selective Service.
Federal employment suitability as determined by a background investigation.
May be required to successfully complete a probationary period.
Participation in direct deposit is mandatory.
MILITARY REQUIREMENTS:
Compatible military grade and assignment required within one year of the effective date of placement. This is an excepted service position that requires membership in a compatible military assignment in the employing state's National Guard. Applicants who are not currently a member of the Ohio Army National Guard must be eligible for immediate membership. Other requirements:
1. Must be able to obtain and maintain the appropriate security clearance of the position.
2. This position is covered by the Domestic Violence Misdemeanor Amendment (30 Sep 96) of the Gun Control Act (Lautenberg Amendment) of 1968. An individual convicted of a qualifying crime of domestic violence may not perform the duties of this position.
3. Ability to establish effective professional working relationships with coworkers and customers, contributing to a cooperative working environment and successful accomplishment of the mission.
4. Irregular and/or overtime (compensatory) hours may be required to support operational requirements or contingencies or may be required to work hours outside of the normal duty day.
5. The duties and responsibilities of your job may significantly impact the environment. You are responsible to maintain awareness of your environmental responsibilities as dictated by legal and regulatory requirements, your organization, and its changing mission.
6. Work may require frequent travel away from the normal duty station on military and commercial aircraft. The work may require the employee to drive a motor vehicle. An appropriate, valid driver's license may be required for the position.
7. Must either be currently in good standing (certified) with a State Bar or able to obtain certification. Must be a graduate of an ABA-accredited law school.
Qualifications
SPECIALIZED EXPERIENCE: Assignments require the first professional law degree (LL.B. or J.D.), active membership in the bar of the highest court of a State, Territory, or the District of Columbia, and more than two years of professional legal experience that is equal to the duties and responsibilities of the position.
CERTIFICATION: Must either be currently in good standing (certified) with a State Bar or able to obtain certification.
Education
It is mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an ABA-accredited law school.
