This National Guard position is for a ATTORNEY-ADVISER (GENERAL), Position Description Number NGT0097000 and is part of the MD JFHQ G1, National Guard.

Duties

Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the
formulation of state/territory legal policy and its execution legal representation; legal initiatives;
interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law;
international law and treaty agreements; and a full spectrum of expert legal advice. Acts as a legal
adviser and attorney for the state/territory National Guard, responsible for assisting in the
formulation of state/territory legal policy pertaining to prevention of sexual assault, sexual
harassment, and domestic abuse, while serving as the special legal advisor to the Adjutant General,
the Office of Staff Judge Advocate (OSJA), Commands SHARP and SEEM programs. Primary
coordinator and advisor in the OSJA pertaining to military justice/adverse actions that are initiated
against alleged offenders. Serves as the primary point of contact for outside entities and
stakeholders, including Special Victims' Counsel, Defense Services, the SARC and the SEEM
Manager preventing future harm to victims by ensuring the proper procedures are implemented and
followed and that justice and adverse actions are administered properly . Assignments include some
of the most diverse, complex, difficult, and novel legal issues found in the emerging area of victims'
right law and is responsible for the formulation of state/territory legal policy and its execution in the
area of sexual assault accountability, prevention, and response; sexual harassment; domestic abuse
and lines of duty and medical discharges for Army and Air personnel . Responsible for advising and
providing legal sufficiency reviews of Adjutant General and other senior leaders messages of sexual
assault and sexual harassment prevention methods in formal and informal settings , and the review
of any implementation of DoD policy or guidance related to competencies leaders must have related
to overseeing prevention. Included in this duty is to assist the Adjutant General, after any required
coordination with the National Guard (NG) Special Victims' Counsel Program , in publishing the
accountability actions taken associated with substantiated allegations of sexual assault, domestic
sexual abuse, and sexual harassment (both formal complaints and violations of the UCMJ), and to
coordinate with local law enforcement, prosecutors, and MCIOs to track cases of sexual assault
involving National Guard perpetrators or victims, and to provide legal support to staff elements
whose duties include sexual assault accountability, prevention, and response, including retaliation
and reprisal. When issues and inquiries arise from the media, congressional, IG and other outside
entities (including SVC), incumbent does the research, gathers relevant information, and drafts
responses on behalf the organization, coordinating with other staff elements as appropriate. Responsible to advise on the legal, factual, and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted, sensitive and emotionally charged issues relating to sexual crimes, harassment, domestic violence/abuse, and to the prevention and response of sexual crimes, harassment, and domestic violence/abuse. ETC Acts as agency counsel for the state/territory National Guard with the National
Guard Bureau Office of Litigation and Employment Law Division, Department of Army and
Department of Air Force Litigation Divisions, and the Department of Justice, for Federal courts of
original or appellate jurisdictions. . Serves as an attorney/adviser providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer, particularly in the area of emerging requirements in victim support and legal resourcing (the Chief of the National Guard Bureau's agent in the state/territory) and active-duty military advisers. Serves as the state/territory Ethics Adviser. Reviews sensitive financial disclosure statements for General Officers and other key personnel. Provides or participates in various training activities, prepares reports, and provides counsel on complex ethics issues and policies; and ensures Federal and state/territory annual administrative reporting requirements are met.

2. This position is covered by the Domestic Violence Misdemeanor Amendment (30 Sep 96) of the
Gun Control Act (Lautenberg Amendment) of 1968. An individual convicted of a qualifying crime of
domestic violence may not perform the duties of this position.

*4. Irregular and/or overtime (compensatory) hours may be required to support operational
requirements or contingencies or may be required to work hours outside of the normal duty day.

regulatory requirements, your organization, and its changing mission.
6. Work may require frequent travel away from the normal duty station on military and commercial
aircraft. The work may require the employee to drive a motor vehicle. An appropriate, valid driver's
license may be required for the position.
7. Must either be currently in good standing (certified) with a State Bar or able to obtain certification.
Must be a graduate of an ABA-accredited law school.
8. This position is designated as Essential Personnel and may be subject to duty in preparation for, or
in response to, a state emergency or disaster declaration. This designation
will not exceed 14 calendar days per year unless otherwise approved in advance by the TAG.

This is a Financial Management Level Certified position IAW the National Defense Authorization Act (NDAA) 2012, Public Law 112-81, subtitle F-financial management, Section 1599d. Incumbent shall comply with the requirements of this certification program.As an Officer in the Army National Guard JAG Corps, must have completed the 14-week Judge Advocate General Basic Course.

Qualifications

GENERAL EXPERIENCE: All series personnel must be competent at the next higher level before being eligible for that level. An applicant must have a validated understanding of the basic principles and concepts of the occupational series and grade.

SPECIALIZED EXPERIENCE: Defined as specified experiences that prepared the applicant to successfully perform the Judge Advocate duties and responsibilities, with the required competency level, as defined by the applicable position description. Each applicant must have the education and validated understanding of the basic principles and concepts of the occupational series and grade for dual status technician appointment to the GS-0905 Attorney-Adviser program positions.Must have at least 12 months work experiences as a professional Attorney Advisor. Knowledgeable of the Army National Guard and Air National Guard mission requirements. Competent in providing legal interpretation and guidance to managers and senior leaders on United States Code Title 32 709, National Guard Program. Able to recognize and identify complex constitutional, state-federal, and military-civilian jurisidictional issues frequently associated with the organization and administration of the Title 32 National Guard, and articulate them in the appropriate forum or context. Competent in providing legal interpretation and guidance to managers and senior leaders on 10 United States Code, and the state equivalent to the federal Uniform Code of Military Justice. Experienced in conducting legal research in connection with cases pending administrative hearings, trials before courts of original jurisdiction, or arguments in appellate courts. Experienced in addressing legal questions referred by administrative officials of the employing agency, such as questions concerning the interpretation and application of statutes, rules, and regulations as they pertain to contracts, claims, or other legal instruments involving private business, state, local, national, or foreign governments. Experienced in addressing questions regarding the effects of provisions of proposed legislation or proposed changes in agency policies or regulations. Experienced in researching and providing legal advice in all functional areas of Administrative, Labor, Medical and Physical Disability, and Ethics Law. Additionally, capable of providing legal assistance in accordance with prescribed instructions and within legal guidelines. Experienced in planning, coordinating, and formulating litigation strategies. Experienced in addressing complex and difficult legal questions and factual issues requiring extensive research, analysis and evaluation of available precedents. Experienced in dealing with issues in the functional areas and demonstrated abilities to quickly identify both the legal and judgmental issues. As a subject matter expert, experienced in determining the facts and recommending effective solutions with minimal guidance or supervision. Experienced in developing and providing solutions to conflicting or contradictory DoD regulations, directives, and policies, and other NGB or state legal guidance. Experienced in addressing and resolving complex and difficult legal case problems, legal questions, or issues involved in the drafting of interpretation or application of legislation, regulations, contracts, decisions, or opinions requiring a solution. Experienced in preparing memoranda of reports that outlined and analyzed the factual and legal issues. Experiences involved preparing legal documents or advisory opinions, participated in contract negations, and examined documents for legal sufficiency. Skilled as a legal litigator and experienced in preparing litigation reports, briefs, pleadings, and other papers associated with civil litigations. Experienced in addressing Federal Labor Management relations and skilled as a participating collective bargaining member of the management negotiating team. Skilled as the subject-matter expert in the complex and constantly evolving area of Medical and Physical Disability and Domestics Operations Law; conducted legal research, investigation and negotiation, and provided legal advice, opinions, recommendations and legal memoranda. Competent to meet with senior military and civilian leadership, high-ranking managers to include Adjutants General, commanders, other staff judge advocates, or other external agencies such as, representatives of the local community and private support organizations, state and local government authorities, or attorneys on an ad-hoc basis.

Quality of Experience: Qualifications are not based solely on time. Qualification factors include experiences in previous Series GS0905, Attorney-Advisor, program positions. A candidate's competencies are evaluated on the basis of duties performed rather than strictly on the rank of the individual; however, established compatibility criteria, awarding requirements for military skills, and military skill training schools are always followed. The applicant's total military service experiences, military and civilian performance records, resume, training certificates, and educational accomplishments must show possession of the competencies needed to fully perform GS-0905 work. The applicant's record of experience, training, and education must show possession of the competencies needed to fully perform the duties of the applicable position description's duties and responsibilities. The applicant must qualify for awarding of the established compatibility criteria that includes the military skill assignment, military rank, and military unit of assignment. The applicant's experience levels, training background, and education must demonstrate a comprehensive competency needed to perform the dual status Series GS-0905 position at its designated grade-level.

For entry into the Army National Guard JAG Corps/ Attorney-Adviser, it is mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an an ABA- accredited law school; and, must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.You must provide transcripts or other documentation to support your Educational claims.
