Summary

This position is located in the Legal Division, Legislation, Regulations & Policy Section (LRPS), Policy Unit. Attorneys in the LRPS Policy Unit serve as subject matter experts for the agency in such critical and high-profile areas such as Community Reinvestment Act, privacy, financial technology (fintech) and innovation, fair lending, and consumer financial protection laws.

Duties

  • Performs highly specialized and complex policy-oriented legal work relating to the FDIC's supervisory and regulatory functions, with particular emphasis on the development of regulations, legislation, and FDIC legal/supervisory policy guidance, and the interpretation and application of the
    statutes and regulations governing consumer financial protection, privacy, supervision, financial technology, and the activities and operations of
    financial institutions.
  • Participates substantially in the formulation of significant, complex, and often precedential, corporate policies or rulemakings through legal analysis of major policy issues affecting financial institution supervision.
  • Prepares legal advisory opinions in response to the most complex, precedent-setting, and significant questions and issues relating to the interpretation of various statutes and regulations governing areas such as consumer financial protection, privacy, and the activities and operations of financial institutions.
  • Prepares written briefings and conducts oral briefings for senior management and staff.
  • Develops and drafts proposed and highly-specialized, complex, and sometimes controversial final rules, regulations, policy statements, and guidelines implementing or interpreting provisions of the Federal Deposit Insurance Act and other laws affecting financial institution.
  • Represents the FDIC in inter-agency task forces, committees, and working groups.

Qualifications

Specialized experience must be directly related to the position being filled and is experience gained after issuance of bar membership.

This position has a positive education requirement, transcripts must be provided showing degree conferred. Official transcripts must be provided prior to appointment.

  • Education: All attorney and law clerk trainee positions have a minimum education requirement of a Juris Doctorate (J.D.) or Bachelor of Laws (LL.B.) or Master of Laws (LL.M.) from a school  accredited by the American Bar Association (ABA).
  • Bar Membership: All attorney positions require current active bar membership (valid license to practice law). Admission to the bar of any state, District of Columbia, any United States territory or Commonwealth, or Federal Court is acceptable. Active Bar membership must be verified prior to appointment. Employees must maintain active bar membership while employed as an attorney with the FDIC.
Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g. Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic, religious spiritual; community; student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. To qualify, applicants must have completed at least one year of specialized experience equivalent to at least the CG/GS-14 grade level or above in the Federal service.  
Specialized experience is defined as analyzing legislation related to financial-services or other legislation affecting government agency policies and procedures, and analyzing and drafting regulations, policies, legal memoranda, opinion letters and other legal documents.

  2. Knowledge of financial institution examination procedures, financial institution practices and procedures, and FDIC policy.
  3. Ability to draft memoranda, legal opinions, and regulations.
  4. Ability to conduct research that includes analyzing and resolving legal and policy issues.
  5. Ability to communicate in writing.
  6. Ability to communicate orally.
  7. Ability to coordinate the work of attorneys, paralegals, and other staff.
  8. Ability to provide senior management officials and policymakers, as well as Congressional committees, heads of other Federal and state agencies and other policy officials, legal analyses, advice, and assistance.
