Summary

About the Position: This is an Attorney-Adviser (General), GS-0905-13 position with the U.S. Army Corps of Engineers, Southwestern Division (SWD), Tulsa District, Office of Counsel. This position will be filled in Tulsa, OK. For more information on USACE Tulsa District click HERE.

Duties

  • Independently advise Contracting Division and other senior leadership on all aspects of the solicitation, award, and administration of government contracts.
  • Utilize a comprehensive working knowledge of various federal procurement statutes and implementing regulations.
  • Review contracts and contract modifications prior to award.
  • Investigate protests to include claims, and appeals.
  • Serve as Trial Attorney for assigned cases that are appealed to the Armed Services Board of Contract Appeals. Prepare litigation reports and provide assistance to the Department of Justice in cases in federal court.
  • Render legal opinions along with providing advice to the Chief, Real Estate Division and his/her staff, Project Delivery Teams, and Command regarding a wide range of real estate questions and issues.
  • Advise on the legal aspects of encroachments which include providing the legal services to remedy encroachments with appropriate legal action.
  • Investigate with recommendations for action on all tort claims against the district including preparation of litigation reports, and assisting the Department of Justice through all phases of litigation.

In order to qualify, you must meet the education requirements described below. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). You will receive credit for all qualifying experience, including volunteer experience. Your resume must clearly describe your relevant experience; if qualifying based on education, your transcripts will be required as part of your application. 1) A signed & dated current Personal Qualifications Statement (SF-171), or an Optional Application for Federal Employment (OF-612) or resume with vacancy announcement number.2) Law School Transcripts & official statement of relative standing in class. A copy is acceptable when applying but certified documents must be furnished before selection. If the applicant's law school does not rank students and the transcript does not explain that the school does not rank students, the applicant must submit an official statement from the law school confirming this practice.3) Official certificate showing that the applicant is a member in good standing of the bar and a sworn statement by the candidate that neither their fitness to practice law or conduct as an attorney has never been challenged in any jurisdiction or; if either has been challenged, a sworn statement giving the facts, circumstances, and any other explanation that the applicant considers appropriate. As an alternative to a sworn statement, a declaration under penalty of perjury may be submitted in the following format: "I declare (or certify, verify or state) under penalty of perjury under the laws of the United States of America that the foregoing is true and correct. Executed on (date) (signature of applicant)." The certificate and statement must be dated within 3 months of the date the application is submitted.4) Examples of writing skills as demonstrated by legal briefs, memoranda, or letters. These examples should total no more than ten pages. Extracts of selected sections of larger documents are acceptable.5) Federal employees/reinstatement eligibles must submit a copy of their latest SF 50 and most recent performance evaluation; and applicants currently serving in the military must submit a copy of their most recent OER.

The following minimum qualification requirements must be met before applicants are eligible for further consideration:

Education Requirements:
Position requires the possession of a professional law degree (LL.B. or J.D.) from law school that is accredited by American Bar Association; also, active membership in the bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. Only degrees from an accredited college or university recognized by the Department of Education are acceptable to meet positive education requirements or to substitute education for experience. For additional information, please go to the Office of Personnel Management (OPM) and U.S. Department of Education websites at http://www.opm.gov/qualifications and http://www.ed.gov/admins/finaid/accred/index.html.Thus, an applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LL.B. or J.D.). As indicated below, a law school transcript must be submitted with your application materials.

Statement of Good Standing: Applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico. As noted below, proof of such membership and good standing must be submitted with your application materials.

Experience: Attorneys performing duties at the GS-13 or equivalent-level positions are expected to perform with substantial independence, even when working on the most complex or difficult matters. Thus, the applicant must have 2 years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LL.M. may substitute for one year of the required professional legal experience.

NOTICE OF VETERAN'S PREFERENCE: There is no formal rating system for applying veteran's preference to attorney appointments in the excepted service; however, the Department of the Army considers veteran's preference eligibility a positive factor for attorney hiring. Applicants eligible for veteran's preference must include that information in their cover letter or resume and attach supporting documents (e.g., DD Form 214, Certificate of Release or Discharge from Active duty) to their submissions.
