Summary

This position is located in the Bureau of Global Talent Management, Grievance Staff (GTM/G). The mission of GTM/G is to investigate grievances and prepare recommendations; oversee implementation of remedial actions; and represent the Department in cases appealed to the Foreign Service Grievance Board.

This position is in the Excepted Service and appointments are made without regard to the requirements of the Competitive Service by laws, Executive order, or OPM regulations.

Duties

  • Provides professional legal expertise to the work of the Grievance Staff. Reviews Foreign Service and Civil Service grievances to identify legal issues and implications.
  • Promotes understanding of and improvements in the Foreign and Civil Service grievance systems and personnel policies and practices in light of the latest Departmental grievance, court, or Board decisions.
  • Directs or personally conducts the investigations. Interviews management officials, colleagues and representatives to establish the facts corroborating or refuting the aggrieved employee’s claims.
  • Drafts the Department’s legal memoranda and/or decision papers that propose or state the Department’s position on the issue(s), supported by a full discussion of the facts of the case and applicable case law.
  • Advises the Director, Grievance Staff, and senior GTM management on the appropriate disposition of grievances, providing advice to the Director, Grievance Staff, and senior GTM management on the appropriate disposition of grievances

Qualifications

All qualification requirements must be met by the closing date of this announcement. Applicants apply for this position must meet the following requirements to be eligible for further consideration:

Law Degree: Applicants must be a graduate of an accredited law school with a J.D. or LL.M.

Bar Membership: Applicants must be a current member of a bar in good standing in any state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.

Experience: Applicants must have at least four years of specialized experience with at least one year equivalent to the GS-14 level in the Federal Service, which provided you with the particular knowledge, skills, and abilities to perform the duties of this position. The specialized experience must have been gained after admission to the bar.

Qualifying specialized experience must demonstrate the following:

  • Experience with employment law, including Federal statutes, administrative regulations, and judicial decisions that pertain to areas of the employer/employee relationship.
  • Experience with all aspects of litigation, including written discovery, depositions, drafting motions, witness preparation, and representing an organization at hearings and trial.
  • Experience with conducting fact finding in order to identify and verify background, events, and individuals associated with grievances as well as ability to negotiate agreements.

There is no substitute of education for specialized experience for the GS-15 position.

  • Skill in, and ability to, orally present factual and legal arguments in formal hearings before administrative authorities as well as in meetings with Departmental senior management.
  • Skill in conducting fact finding investigations in order to identify and verify the background, events, and individuals associated with individual grievances.
  • Ability to negotiate settlement agreements with parties holding widely divergent objectives and points of view.
  • Ability to draft clear legal arguments citing applicable laws, regulations, and precedent.
