The position of Deputy Associate General Counsel, Division of Legal Counsel, is located in the Division of Legal Counsel in the Office of the General Counsel. The Deputy Associate General Counsel reports to the Associate General Counsel in the Division. The incumbent of this position works with the Associate General Counsel, who reports directly to the General Counsel and the Deputy General Counsel.

Duties
The Deputy assists the Associate General Counsel, who exercises responsibility for administration of Division of Legal Counsel functions; in the absence of or at the designation of the Associate General Counsel, the Deputy acts in his or her stead as the head of the Division with full authority, as alter ego, to take action on any matters directed to the attention of the Associate General Counsel.
As the Deputy Associate General Counsel the incumbent:
Assists to directs and coordinate the activities of the Agency's Privacy Counsel, and the three branches in the Division of Legal Counsel: Contempt, Compliance, and Special Litigation; FOIA Branch; and E-Litigation Branch.
Assists the Associate General Counsel's full charge of and final substantive responsibility for much of the Agency's contempt and compliance work, seeking to effectuate compliance with court judgments through contempt litigation in the U.S. Courts of Appeals and to investigate and litigate compliance issues to preserve and ensure effective remedies under the Act. Litigation may be in U.S. Bankruptcy Courts, U.S. District Courts, U.S. Courts of Appeals, and occasionally state courts.
Assists the Associate General Counsel's full charge of and final substantive responsibility for much of the Agency's non-mission related special litigation including: defensive litigation brought by parties seeking to enjoin the Agency, challenge rulemaking, mandamus the Agency to act, obtain attorneys' fees under the Equal Access to Justice Act, appeal district court decisions enforcing Agency subpoenas; offensive litigation to protect the jurisdiction of the Agency from outside litigation that may interfere with the Agency's authority, or to protect the enforcement of the NLRA from preempted state or local laws. Litigation may be in U.S. Bankruptcy Courts, U.S. District Courts, U.S. Courts of Appeals, and occasionally state courts. Matters in the U.S. Supreme Court are coordinated with the Appellate and Supreme Court Litigation Branch and the Solicitor General's office of the Department of Justice.
Assists the Associate General Counsel with effectuating substantive responsibility for matters handled by the E-Litigation Branch, including recommending and implementing Agency policy and procedures related to managing electronic discovery, litigation support related to electronically-stored information, and information governance.
Assists the Associate General Counsel's full charge of and final substantive responsibility for matters handled by the FOIA Branch, including overseeing responses to FOIA requests and responding to FOIA administrative appeals.
Represents the General Counsel in meetings and consultations with such persons or groups as legal representatives of other government agencies, Congressmen, or representatives of parties in proceedings before the Agency.
Assists the Associate General Counsel in ensuring efficient coordination and management within the Division and effects proper coordination with the Office of the General Counsel and the Board and other Divisions under the General Counsel on all litigation and related policy questions under its jurisdiction. Appears, as requested by the General Counsel, before Congressional Committees, and as required, makes speeches and addresses public meetings on behalf of the General Counsel.
Assists the Associate General Counsel in ensuring Agency compliance with privacy matters, including the Privacy Act of 1974, and with requirements to protect and manage Controlled Unclassified Information.

Qualifications
THIS POSITION IS IN THE SENIOR EXECUTIVE SERVICE (SES): This position is designated as a General position. This position may be filled by a career or non-career appointee. Candidates are not required to have previous SES career service before applying. The selected candidate executive/managerial qualifications must be certified by the Office of Personnel Management prior to an initial SES career appointment. Positions in the SES are ungraded.

Education
Applicant must possess a J.D. or LL.B. degree and be a member of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico.
