Summary

The Civil Division of the U.S. Department of Justice is seeking an individual to serve as Senior Level Appellate Counsel (False Claims Act) in its Appellate Staff.

Duties

The Senior Level Appellate Counsel (False Claims Act) serves as a technical expert and coordinator for attorneys in the Appellate Staff and across the Division in False Claims Act litigation, and as a resource for other offices and agencies that require advice on difficult matters under the False Claims Act. Additionally, the incumbent assists, as appropriate, with the Division's False Claims Act cases in the Supreme Court, including preparing certiorari petitions and briefs for submission to the Court. The Senior Level Appellate Counsel (False Claims Act) prepares recommendations for or against appeal or rehearing in cases that fall within the incumbent's area of expertise, in which lower court decisions are averse to the government. The Senior Level Appellate Counsel (False Claims Act) also serves as a technical expert on other significant appellate litigation as assigned.

  • You must meet all minimum qualifications to be deemed eligible. Only experience obtained by closing date of this announcement will be considered
  • This position requires you to submit a Public Financial Disclosure Report (OGE 278) upon entry, and annually thereafter in accordance with DOJ and Federal ethics guidelines.
  • You will be required to obtain and maintain a final Sensitive Compartmented Information Clearance. Failure to obtain and maintain the required level of clearance may result in withdrawal of the job offer or removal.
  • It is the policy of the Department to achieve a drug-free workplace and you may be required to pass a drug test which screens for illegal drug use prior to final appointment.
  • Upon conversion to a permanent appointment with the Department, all Department attorneys are subject to a two-year trial period.
  • May require completion of a 14-month temporary appointment, subject to extension, pending the completion and adjudication of your background check.
  • Selective Service registration is required for males born on, or after, December 31, 1959. Those not registered should have an approved exemption on file.
  • You must be a United States Citizen or National.

Qualifications

Applicants must possess a J.D. degree, be duly licensed and authorized to practice as an attorney under the laws of any State, territory of the United States, or the District of Columbia, and be an active member of the bar in good standing.

Applicants must have a high degree of professional skill and extended training and experience in Federal law, including the False Claims Act. The incumbent must have an intimate grasp of its specialized and highly technical scheme, which involves working not only with government agencies, but also private relators authorized under the statute to proceeds as private attorneys general. In addition, applicants must possess deep familiarity and experience with the procedural and strategic aspects of Supreme Court and appellate litigation on behalf of the federal government. Applicants must be able to solve novel and highly complex problems in the short space of time allowed by court deadlines.

YOU WILL BE EVALUATED ON ALL OF THE FOLLOWING MANDATORY TECHNICAL QUALIFICATIONS (MTQs):

Your responses to the MTQs should be submitted in one document that includes separate narrative statements addressing each of the 2 Mandatory Technical Qualifications (NOT TO EXCEED 2 PAGES PER MTQ, 4 PAGES TOTAL).

MTQ1. Demonstrated expertise and experience in personally handling exceptionally challenging and precedential appellate cases involving False Claims Act suits.

MTQ2. Demonstrated deep familiarity and experience with the procedural and strategic aspects of Supreme Court and appellate litigation on behalf of the federal government.

Applications without MTQ narrative statements will not be considered.
