Duties

  • Individually and through staff, counsels and advises the FDIC's Division of Risk Management Supervision (RMS) and Division of Depositor and Consumer Protection (DCP) management and staff regarding Risk and Compliance examinations, visitations, and other supervisory functions.
  • In collaboration with the Regional Counsel, supervises the preparation of legal opinions for RMS and DCP in connection with potential unsafe and unsound practices, breaches of fiduciary duties, or violations of laws or regulations that may be discovered during examinations or visitations. Ensures that the factual record supports such legal opinions and that all legal authorities have been researched thoroughly. Reviews and edits such opinions for substantive, strategic, and policy reasons. Coordinates interpretations of banking and consumer protection laws and regulations with other designated subject matter experts (SMEs) in the Legal Division to ensure consistent interpretations of these laws and regulations.
  • In connection with appeals of material supervisory determinations before the committee or office designated for handling appeals of material supervisory determinations under Section 309(a) of the Riegle Community Development and Regulatory Improvement Act (MSD Appeals), oversees Legal staff assigned to assist RMS and DCP in connection with the issuance of the Division Director decision. Individually and through staff, addresses RMS and DCP questions regarding the MSD Appeals process. 
  • Takes a lead role in developing and drafting highly-specialized, complex, and sometimes controversial proposed and final rules, regulations, policy statements, and guidelines implementing or interpreting provisions of the Federal Deposit Insurance Act related to enforcement or supervision, and in consultation with rulemaking subject matter experts in the Legal Division and the client divisions, ensures that such rules, regulations, policy statements comply with all applicable legal and technical requirements (e.g., Administrative Procedure Act, Paperwork Reduction Act, and Regulatory Flexibility Act).
  • Participates in the development, implementation, and oversight of the FDIC’s policies and procedures related to the issuance of legal opinions on risk and compliance matters, the referral of fair lending matters to the U.S. Dept. of Justice, and handling of complaints received related to misrepresentations of deposit insurance or misuse of the FDIC’s name or logo.
  • Supervises the work of legal staff in Washington that are involved in fair lending reviews and works with counterparts in DCP to oversee the referral of fair lending cases to the U.S. Dept. of Justice, as required under the Equal Credit Opportunity Act.
  • Supervises the work of attorneys and supports staff handling requests for confidential supervisory information (CSI) or personally identifiable information (PII) related to documents in the possession or control of DCP or RMS. Works with legal staff to review, approve, and edit information sharing agreements (ISAs). Ensures that all ISAs comply with Part 309 of the FDIC’s Regulations, the Privacy Act of 1974, and the Right to Financial Privacy Act, and FDIC policies and procedures regarding the sharing of CSI and PII.
  • Confers and acts in an advisory capacity to Assistant General Counsel for Enforcement, Deputy General Counsel, and members of the Board of Directors on any legal questions relating to unsafe or unsound practices, breaches of fiduciary duties, and violations of banking and consumer protection laws and regulations.
  • Manages a team of attorneys and paralegals engaged in the interpretation and application of banking and consumer protection laws and regulations applicable to insured depository institutions (IDIs), institution-affiliated parties (IAPs), and other covered persons.
  • Promotes a work environment free of discrimination and harassment. Fulfills labor/management relations responsibilities consistent with established practices and procedures. Completes work with a high degree of independent judgment, within short time frames, and with a high level of accuracy. Identifies issues and problems and appropriately raises concerns to Assistant General Counsel for Enforcement.

Qualifying experience may be obtained in the private or public sector. Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. Technical Experience: Experience as a practicing attorney in a banking or regulatory environment that involves conducting legal work of a highly complex nature that has a major impact on an organization's corporate, supervision, legislative, and enforcement functions.

Basic Qualification: License to practice before the highest court of a state, territory, commonwealth, or the District of Columbia and in good standing.
