Summary

THIS IS A NATIONAL GUARD TITLE 32 EXCEPTED SERVICE POSITION.

This National Guard position is for a ATTORNEY-ADVISER (GENERAL) (TITLE 32), Position Description Number NGD1240000 and is part of the TN ARMY Army National Guard.

Duties

As an ATTORNEY - ADVISER (GENERAL) GS-0905-13 you will act as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; trial defense; and a full spectrum of expert legal advice. Be responsible to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted and emotionally charged issues such as intelligence oversight related to Homeland Security, or advising on Federal and state/territory Executive Orders for the use of federalized troops in response to domestic emergencies and natural disasters. Serve as the state/territory National Guard litigation point of contact. Serve as an attorney/adviser providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer (the Chief of the National Guard Bureau's agent in the state/territory) and active-duty military advisers. Act as the Adjutant General's representative in third-party proceedings under Federal labor management and equal employment opportunity statutes and regulatory provisions. Advise the convening authorities, including the state/territory Adjutant General, on procedural and legal issues associated with Courts Martial, Non-Judicial Punishment Administrative Board proceedings and subsequent actions. Serve as the state/territory Ethics Adviser. Serve as claims officer for the state/territory National Guard. Provide oversight and guidance to the state/territory Judge Advocate's Legal Office, Legal Assistance and Preventative Law Programs, and supervises assigned full-time attorney and support staff. Perform other duties as assigned.

  • Acceptance of a Federal position may terminate Tricare Reserve Select eligibility.
  • For positions requiring a security clearance (Secret or Top Secret) the applicant must possess or be able to obtain a clearance within one year of appointment.
  • May occasionally be required to work other than normal duty hours; overtime may be required.
  • No record of conviction by civilian courts of offenses listed in the applicable Service Military Justice regulations.
  • Must not have any military disciplinary action (Article 15 or Court-Martial) on military records for engaging in an unprofessional or inappropriate relationship as defined in applicable DoD instructions.
  • Must not have any Unfavorable Information Files, civil convictions (other than minor traffic violations), or open Inspector General investigations.
  • Mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an ABA- accredited law school; and must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.

Qualifications

Military Grades: O-2 through O-4

GENERAL EXPERIENCE:Skill collecting and analyzing data effectively, efficiently and accurately. Knowledgeable of military and civilian laws, directives, regulations, policies, and procedures; ability to clearly enunciate English without impediment of speech that would interfere or prohibit effective communications. Skilled interpersonal communications, empathy, and effective listening. Ability to write English in reports and presentation formats. Ability to communicate-orally and in writing-clearly and effectively. Ability to organize thoughts, research materials and manage case projects. Skill comprehending and interpreting directives and laws.

SPECIALIZED EXPERIENCE: Must have 36 months work experience as a professional Attorney Advisor. Be knowledgeable of the Army National Guard and Air National Guard mission requirements. Competent in providing legal interpretation and guidance to managers and senior leaders on United States Code Title 32 709, National Guard Program. Able to recognize and identify complex constitutional, state-federal, and military-civilian jurisdictional issues frequently associated with the organization and administration of the Title 32 National Guard and articulate them in the appropriate forum or context. Competent in providing legal interpretation and guidance to managers and senior leaders on 10 United States Code, and the state equivalent to the federal Uniform Code of Military Justice. Experience conducting legal research in connection with cases pending administrative hearings, trials before courts of original jurisdiction, or arguments in appellate courts. Experience addressing legal questions referred by administrative officials of the employing agency, such as questions concerning the interpretation and application of statutes, rules, and regulations as they pertain to contracts, claims, or other legal instruments involving private business, state, local, national, or foreign governments. Experience addressing questions regarding the effects of provisions of proposed legislation or proposed changes in agency policies or regulations. Experience researching and providing legal advice in all functional areas of Administrative, Labor, Medical and Physical Disability, and Ethics Law. Capable of providing legal assistance in accordance with prescribed instructions and within legal guidelines. Experience planning, coordinating, and formulating litigation strategies. Experience addressing complex and difficult legal questions and factual issues requiring extensive research, analysis and evaluation of available precedents. Experience dealing with issues in the functional areas and demonstrated abilities to quickly identify both the legal and judgmental issues. Experience determining the facts and recommending effective solutions with minimal guidance or supervision. Experience developing and providing solutions to conflicting or contradictory DoD regulations, directives, and policies, and other NGB or state legal guidance. Experience addressing and resolving complex and difficult legal case problems, legal questions, or issues involved in the drafting of interpretation or application of legislation, regulations, contracts, decisions, or opinions requiring a solution. Experience preparing memoranda of reports that outlined and analyzed the factual and legal issues. Experience preparing legal documents or advisory opinions, participated in contract negations, and examined documents for legal sufficiency. Skill as a legal litigator and experience preparing litigation reports, briefs, pleadings, and other papers associated with civil litigations. Experience addressing Federal Labor-Management relations and skill as a participating collective bargaining member of the management negotiating team. Skill as the subject-matter expert in the complex and constantly evolving area of Medical and Physical Disability and Domestics Operations Law. Conduct legal research, investigation and negotiation, and provide legal advice, opinions, recommendations and legal memoranda. Experience reviewing programs that requires analysis of interrelated issues of effectiveness, efficiency, productivity, and developing recommendations to resolve issues and problems. Experience developing recommendations for overall detailed plans, goals, and objectives for implementation and evaluation of the legal program. Experience addressing issues, problems or concepts and skilled in observations and analysis projections. Experience which includes addressing difficult and sensitive issues based on variations in the nature of the processes evaluated, the diverse missions of the units assigned, and resource limitations; experience compiling, reconciling, and correlating data from a various sources, separate service programs, and integral record systems. Experience researching, cross-checking information, and interpreting data to obtain accurate and relevant information. Experienced and skill collecting information, documenting data to substantiate and validate findings, facts, or violations of government policies, procedures, and instructions. Skill negotiating with those who resist responding or cooperating, due to such issues as organizational conflict, competing objectives, or limited resources. Skill influencing managers or other staff officials to accept and implement findings or recommendations. Competent to meet with senior military and civilian leadership, high-ranking managers to include Adjutants General, commanders, other staff judge advocates, or other external agencies such as, representatives of the local community and private support organizations, state and local government authorities, or attorneys on an ad-hoc basis.

Education

The following education requirements are mandatory:

Bachelor of Laws or Juris Doctor degree in law issued by an ABA- accredited law school; and, must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.

As an Officer in the Army National Guard JAG Corps, must have completed the 14-week Judge Advocate General Basic Course.

In addition to the standard education requirements and law degree qualifications, education achievements are allowed as limited substitutions for specialized experience factors in the GS-0905-12, JFHQ Attorney-Adviser position
