Duties

This position is located at Missile Defense Agency's (MDA's) Office of General Counsel (GC) with duty at Huntsville, Alabama. The General Counsel is responsible for providing all legal services to be performed within and involving the MDA under the authority, direction and control of the GC and the Deputy GC for General Law. The incumbent serves as Associate General Counsel for General Law providing legal advice and support on an agency-wide basis to all MDA activities and organizations on issues that impact both the management and operations of the agency. Independently decides a broad range of legal issues on matters involving civilian personnel law, government ethics, environmental law, fiscal law, security law and all other areas of administrative law. Furnishes legal opinions and advice concerning the AcqDemo performance management system, adverse actions, disciplinary matters, adherence to the merit system principles, prevention of prohibited personnel practices, employee grievances, labor relations issues and equal employment opportunity issues. Provides professional legal advice to managers and employees on all matters affecting the day-to-day operations and management of the agency to ensure agency operations are in compliance with relevant laws and regulations. Represents the agency in matters before the Merit Systems Protection Board (MSPB), Equal Employment Opportunity Commission (EEOC) and the Office of Special Counsel (EEOC). Provides direct support to the Deputy General Counsel preparing legal opinions that are well written, properly researched and legally correct

Employee must have at least two years specialized professional legal experience in the federal service or private sector at the NH-03/GS-13 level which has given me the particular knowledge, skills, and abilities to perform successfully the duties of the position, and that is typically found in or related to the work of the position to be filled. Examples of specialized experience are as follows:
  • Ability to quickly and accurately analyze complex legal questions.
  • Ability to prepare briefs, legal opinions and other legal documents that are well-written and legally correct.
  • Ability to successfully prepare and litigate legal matters involving complex issues.
  • Ability to communicate both formally and informally with both junior and senior level personnel.

Veteran's Preference:
There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Defense considers veterans' preference eligibility a positive factor for attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., DD Form 214, "Certificate of Release or Discharge from Active Duty") to their submissions. Although the point-preference system is not used, applicants eligible to claim a 10-point preference must submit a Standard Form (SF) 15, "Application for 10-Point Veteran Preference," and supporting documentation required for the specific type of preference claimed. You must be a graduate from an accredited law school, and be in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico Bar.
