Summary

Duties

The incumbent is responsible for leading the Division of Enforcement, one of the eight divisions in the Federal Trade Commission's Bureau of Consumer Protection. The Division of Enforcement is responsible for prosecuting federal district court cases against businesses engaged in unfair or deceptive acts or practices in violation of the Federal Trade Commission Act or violations of other consumer protection laws or rules, for seeking civil or criminal contempt citations for violators of federal district court orders, and for seeking civil penalties for violations of administrative cease and desist orders.

The incumbent manages a wide range of programs addressing consumer protection including ensuring compliance with federal district court and administrative orders through compliance reviews, civil penalty and civil contempt actions, and criminal contempt referrals; conducting investigations and prosecuting civil actions to stop unfair or deceptive acts or practices; enforcing select consumer protection rules; and managing BCP's regulatory reform program. The incumbent manages a large staff of attorneys, investigators, and support staff engaged in law enforcement activities including complex investigations, federal district court and administrative litigation, rulemaking, workshops, coordination with other federal agencies including the Department of Justice, industry guidance, and policy development. The incumbent also supervises the Criminal Liaison Unit.

The incumbent provides counsel and guidance for staff members on policy questions and matters of legal strategy and reviews the more significant legal documents prepared by the staff (e.g., proposed complaints, recommendations that cases be closed, settlement agreements, motions, proposed findings, and proposed orders) for consistency with agency policy, soundness of judgement, and legal sufficiency. In addition, the incumbent reviews staff recommendations to: initiate investigations, issue civil investigative demands and subpoenas, issue formal complaints for violations, initiate negotiation of consent agreements, initiate rulemaking, close investigations, and file federal district court or administrative charges. The incumbent decides which course of action to pursue based on assessment of relative sufficiency of information provided to support the recommendation.

The incumbent is accountable for ensuring the success of Division cases and programs, which includes obtaining and allocating necessary resources to accomplish goals, consistent with resource and budgetary constraints, as well as dealing with key officials within and outside the agency to gain an understanding of and support for the Division's work. The incumbent sets effectiveness, efficiency, and productivity performance requirements, structures the Division's work to meet these requirements, and implements management and internal control standards. The incumbent monitors and evaluates the Division's progress toward goals through formal and informal means, periodically evaluates and makes appropriate adjustments to such goals, and assesses the Division's overall effectiveness, efficiency, and productivity.

TECHNICAL QUALIFICATIONS (TQs): Your resume should demonstrate accomplishments that would satisfy the technical qualifications.

TQ 1: Demonstrated knowledge and experience involving the application of the Federal Trade Commission Act and a wide range of statutes and rules, including the Restore Online Shoppers' Confidence Act and the Made in USA Rule.

TQ 2: Demonstrated executive-level experience managing all aspects of litigation, including analyzing complex legal issues and questions of litigation strategy, reviewing pleadings and memoranda, and supervising and reviewing the work of attorneys and other staff.


EXECUTIVE CORE QUALIFICATIONS (ECQs): In addition to the Technical Qualification Requirements listed above, all new entrants into the Senior Executive Service (SES) under a career appointment will be assessed for executive competency against the following five mandatory ECQs. ECQ 4: Leading People - This core qualification involves the demonstrated ability to lead and inspire a group toward meeting the organization's vision, mission, and goals, and to drive a high-performance, high-accountability culture. This includes, when necessary, the ability to lead people through change and to hold individuals accountable.

ECQ 5: Achieving Results - This core qualification involves the demonstrated ability to achieve both individual and organizational results, and to align results to stated goals from superiors.

Note: If you are a member of the SES or have been certified through successful participation in an OPM approved SES Candidate Development Program (SESCDP), or have SES reinstatement eligibility, you do not need to respond to the ECQs.
