Duties
The Federal Energy Regulatory Commission (FERC) is looking for an experienced senior level executive to serve as the Deputy Associate General Counsel, Energy Projects in the Office of the General Counsel (OGC). The Deputy Associate General Counsel reports directly to the Associate General Counsel and is a key legal advisor on the full range of Commission regulatory responsibilities relating to the certification of natural gas pipelines, certification of facilities for the import or export of natural gas, licensing of hydroelectric projects, and siting of transmission facilities in national interest electric transmission corridors.
The Deputy Associate General Counsel supports the Associate General Counsel in:
- Directing the provision of legal and policy counsel on matters related to the Commission’s jurisdiction, including: the permitting, construction, acquisition, operation, and abandonment of natural gas pipeline facilities and facilities for import and export of natural gas; the licensing and related regulation of hydroelectric projects and dam safety; and the siting of transmission in national interest electric transmission corridors;
- Managing the preparation, for Commission consideration, of memoranda and draft notices, opinions, orders and rulemakings involving Commission-jurisdictional matters arising under Part I of the Federal Power Act, sections 405 and 408 of the Public Utility Regulatory Policies Act, the Natural Gas Act, the Natural Gas Policy Act, the Interstate Commerce Act and Outer Continental Shelf Lands Act, and section 216 of the Federal Power Act;
- Managing the preparation of memoranda and analyses of any other statutes that may affect or relate to the Commission's responsibilities in the area of energy projects, including the National Environmental Policy Act, Clean Water Act, Endangered Species Act, National Historic Preservation Act, and Coastal Zone Management Act;
- Overseeing the formulation of legal and policy positions of the Office of the General Counsel (OGC) and the Commission on issues involving the Commission's regulatory responsibilities under the above statutes;
- Providing legal and policy direction on Commission disposition of initial decisions by Commission administrative law judges, including interpretation of relevant statutes, regulations, judicial and Commission precedents, and relevant consideration of public policy;
- Responding to oral and written inquiries from the general public, Congress, the Executive Branch, or other interested parties;
- Directing legislative analysis and preparation of Congressional testimony involving subject matter responsibility, and representing the Commission in Congressional committee meetings involving proposed legislation; and
- Representing the Commission, and explaining and advocating for its legal and policy positions, in meetings with other agencies and affected interest groups.

Qualifications

TECHNICAL QUALIFICATIONS (TQs): Your resume should demonstrate accomplishments that would satisfy the technical qualifications.
TQ 1: Demonstrated experience providing expert counsel on FERC regulatory matters involving natural gas pipeline certification, certification of facilities for the import of export of natural gas, and hydroelectric project licensing.
TQ 2: Demonstrated experience interpreting and applying federal energy statutes, regulations, and FERC orders to complex jurisdictional matters and in formulating legally sound recommendations.
EXECUTIVE CORE QUALIFICATIONS (ECQs): In addition to the Technical Qualification Requirements listed above, all new entrants into the Senior Executive Service (SES) under a career appointment will be assessed for executive competency against the following five mandatory ECQs. There are five ECQs:

- ECQ 2: Driving Efficiency -This core qualification involves the demonstrated ability to strategically and efficiently manage resources, budget effectively, cut wasteful spending, and pursue efficiency through process and technological upgrades.
- ECQ 3: Merit and Competence - This core qualification involves the demonstrated knowledge, ability and technical competence to effectively and reliably produce work that is of exceptional quality.
- ECQ 4: Leading People - This core qualification involves the demonstrated ability to lead and inspire a group toward meeting the organization’s vision, mission, and goals, and to drive a high-performance, high-accountability culture. This includes, when necessary, the ability to lead people through change and to hold individuals accountable.
- ECQ 5: Achieving Results - This core qualification involves the demonstrated ability to achieve both individual and organizational results, and to align results to stated goals from superiors.
Note: If you are a member of the SES or have been certified through successful participation in an OPM approved SES Candidate Development Program (SESCDP), or have SES reinstatement eligibility, you do not need to respond to the ECQs. Instead, you should attach proof (e.g., SF-50, Certification by OPM’s SES Qualifications Review Board (QRB)) of your eligibility for noncompetitive appointment to the SES.
Education
You must meet the following basic requirements, by the closing date of this announcement: (1) hold a Juris Doctorate (J.D.) or Bachelor of Laws (LL.B.) from an accredited college or university and (2) be a current, active bar member in good standing. You must upload transcripts with your application.

Duty Station: The duty location of this position is Washington, DC.

Ethics Training: Attend a mandatory ethics training. We are governed by the Office of Government Ethics (OGE) Standards of Conduct, the criminal conflict of interest statutes, and FERC’s supplemental ethics regulation, which specifically prohibits FERC employees from holding certain energy-related securities. To comply with these regulations and statutes, divestiture of at least some energy securities is likely to be required after you begin employment. Mobility: Organizational and geographical mobility is essential in developing and managing SES leaders. Individuals selected for SES positions members may be subject to reassignment across geographical, organizational, and functional lines, and may be required to sign a Reassignment Rights and Obligation Agreement.
Tiering: The Commission structures its SES positions into categories (i.e. tiers) to determine the pay range for each position. The categories are based on the position scope, breadth, functions, and placement within the structure of organizational levels across the Agency.
