Summary

This position is located in the Appellate Litigation Unit of the Legal Division and is responsible for litigating, overseeing, and monitoring all appeals in which the FDIC in any capacity is a party or has an interest.

Duties

  • Reviews, researches, files, briefs, and argues cases before appellate courts involving the FDIC.
  • Prepares memoranda on legal and litigation issues, including those involving questions of first impression and with conflicting precedent that require extensive research, analyses, and/or unusual ingenuity to resolve.
  • Provides advice and counsel to other divisions and to senior management officials on the development of FDIC policies and positions.
  • Represents the Unit, Section, Branch, and Division on task forces, committees, and working groups dealing with matters of concern to the FDIC and represents the views of the Legal Division with top management officials of the FDIC and other organizations, in particular financial regulatory agencies and Department of Justice.
  • Interprets and applies relevant statutory and regulatory provisions to the development and assessment of policy initiatives.
  • Presents findings, conclusions, options, and recommendations to decision-making and policymaking officials.
  • Acts as project leader and trains and reviews the work of attorneys on specific cases, investigations, and projects.

Qualifications

Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic, religious/spiritual; community; student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Additional qualifications information can be found here.

To qualify, applicants must have completed at least one year of specialized experience equivalent to at least the 14 grade level or above in the Federal service. Specialized experience is defined as experience litigating all aspects of appeals; analyzing legal and litigation issues to propose solutions; providing legal analysis, advice, and guidance; and providing oversight and guidance on legal cases and matters.

Specialized experience must be directly related to the position being filled and is experience gained after issuance of bar membership.

This position has a positive education requirement, transcripts must be provided showing degree conferred. Official transcripts must be provided prior to appointment.

  • Education: All attorney and law clerk trainee positions have a minimum education requirement of a Juris Doctorate (J.D.) or Bachelor of Laws (LL.B.) or Master of Laws (LL.M.) from a school accredited by the American Bar Association (ABA).
  • Bar Membership: All attorney positions require current active bar membership (valid license to practice law). Admission to the bar of any state, District of Columbia, any United States territory or Commonwealth, or Federal Court is acceptable. Active Bar membership must be verified prior to appointment. Employees must maintain active bar membership while employed as an attorney with the FDIC.

Additional information

Selectee(s) for this position will be required to report to their duty station office at least 1 day per pay period beginning January 2, 2024, and at their supervisor’s direction to support mission and project needs. In person reporting requirements are expected to increase in July 2024.

Salary reflects a pay cap for this position of $252,500.

If selected, you may be required to serve a probationary or trial period as applicable to appointment type.

  3. Ability to provide senior management officials and policymaker’s advice, and guidance on controversial and precedent-setting issues affecting the FDIC.
  4. Ability to deal effectively with others.
  5. Ability to analyze legal and litigation issues and to propose effective solutions in oral presentations.
  6. Ability to mentor, develop, and train legal attorneys and staff and client groups on litigation and legal issues.
  7. Ability to coordinate the work of attorneys, paralegals, business groups, and other staff.
